Now, the majority of the events surrounding my posting entitled “THE UNLAWFUL CUSTODY AND VISITATION PROCEEDING IN ONONDAGA COUNTY OF MICHAEL ROTONDO REGARDING HIS SON. (PART 12)“, were overshadowed by the fact that the police had stopped making reports for my visitation violations. And to proceed with the description of subsequent events, I really need to describe the cause for my son’s mother refusing my visitation on June 13, 2017.

On June 11, 2017, my son (and myself as well) had received a sunburn while my son was in my care, and my son’s mother had refused my visitation for that same June 13th because I wasn’t providing ‘answers’ to her about the sunburn. (It’s an effect of the sun, and may be prevented through the application of sunscreen; and  I was told that it had already been applied onto him while he was in the care of his mother)

Also, for the following text messages, we had a tandem bike, and he had nothing on his feet because his sandals went missing at the park; There wasn’t anything I could do about that as I didn’t have a second pair handy.

The water that you send in a water bottle isn’t the only water (or source of hydration) available to him. I’m not going to
make him drink if he’s not thirsty that isn’t good for him. While he was here she didn’t appear sunburned or say anything
the lead me or anyone else to believe that he was sunburned.

And he didn’t get the burn the last half hour he’s been home
And yes, on hot days if he didn’t drink water he can get dehydrated
So yes, you do have him drink water
And if you plan on not keeping him from getting burned and dehydrated He won’t be going over there
As the supervising adult, you have to make sure those things are under control
So you didn’t hand him drink water? You didn’t reapply sunblock? Neither of those? And he was outside all day in and out of water?

I have one overnight per week. If he doesn’t want to stay overnight after the fireworks he doesn’t have to as far as I’m
concerned. And over the past few years because you have him on the fourth, I’ve been taking him to multiple other
displays to compensate for that, so if you still want him for the fourth I’m going to want to take him to other displays,
becides what I’m always entitled to with the overnights.

Did you not reapply? He didn’t drink water when he was clearly outside the whole day on a 90° day. That’s neglect. He rode his bike home with nothing on his feet.

Medical history is relevant, ask a lawyer, ask his lawyer, ask anyone
Your refusal to answer will only look bad on you, and it will come out either way
So you have an untreated mental illness, could be genetic, not irrelevant.

I don’t have to answer any of your questions. The court order is binding and it is crystal clear that the problem here is
you.

Now, if a child is being harmed while visiting with a parent; there is an emergency proceeding available through Onondaga County, where someone can get same day service for an order of protection; meaning that if there’s a court order for visitation and it needs to be suspended immediately, you have the means to be heard by a judge and get that visitation suspended that same day but, my son’s mother didn’t do this; and it’s simply because she couldn’t. It was just a sunburn, and I was sunburned too; sometimes people get sunburns. What she did instead, was hold my visitation hostage in an attempt to coerce me into saying something that could be used against me.

I couldn’t say “yes I forgot to put sunscreen on him”, because that could then be use to stop my visitation. And considering the way that the court was handling my matters, I’m sure they would have loved the opportunity to take a sunburn, which doesn’t show neglect, and “find” that it does show neglect; so they could then take my visitation away on record. If there was no such risk of such incrimination, then why was she trying so hard to get me to say that I didn’t put sunscreen on him?

For the rest of the summer I made sure we applied sunscreen often, and I also made him wear a shirt too. Another sunburn could possibly substantiate the loss of my visitation rights on record although as it seems, a proceeding for the suspension of visitation isn’t truly necessary, if it is the wishes of the court for it to be suspended.

So then because I didn’t allow my son’s mother to coerce incriminating testimony from myself, I didn’t see my son on Fathers’ day (June 18, 2017); which I’ll write about in next week’s posting.

I guess treating someone like they shouldn’t have custody/visitation of their child, until they show something that can be used to substantiate it, isn’t something that can always be depended on.

  1. Dude… It’s 2019, not 1950. You need to update your knowledge base regarding repeated application of sunscreen (it’s on the bottle), increased risk of skin cancer as a direct result of sunburn, and proper hydration. If I were this child’s mother, I would be angry, as well.

  2. Well it sounds like a typical dad thing to forget about stuff like this. It doesn’t sound like he suffered acute kidney injury from dehydration or severe third degree burns. I’m assuming he looked OK to you and was able to make his needs known. I just wish you could have some time with your son now, as that would be best for him. He is untimatly the one who loses in this situation.
